1. Who you are agreeing with

Ember is operated by Digitiz ("we", "us"). By downloading or using Ember you accept these terms. If you do not accept them, do not use the app.

2. Who may use Ember

You must be at least 13 years old to use Ember. In parts of the European Economic Area the minimum age for agreeing to online services on your own is 16; where that applies to you, that is the age for Ember too.

If you are under the age of majority where you live, you may only use Ember with a parent or guardian's involvement, and only they can agree to a subscription.

3. Your licence to use the app

We give you a personal, non-exclusive, non-transferable, revocable licence to use Ember on devices you own or control, for your own non-commercial use. You may not copy, sell, rent, sublicence, or redistribute the app, reverse-engineer it except where the law expressly permits it, or use it to build a competing product.

Ember is licensed to you, not sold. If you got it from the App Store or from Google Play, your use of it is also subject to that store's own usage rules, and where they are stricter than this section, they win.

4. Your account

You can use Ember as a guest without signing in. A guest account lives on that device: if you uninstall the app, reset the device, or lose it, that progress is gone and we cannot restore it. Signing in with Google or Apple is what makes your progress survive.

You are responsible for what happens under your account and for keeping your sign-in secure. Pick a username that is yours to use — not someone else's name, trademark, or an impersonation — and keep it inoffensive. We can reclaim a username that breaks this.

You can delete your account at any time from Settings → Account → Delete account, or by emailing us. It is permanent. The full procedure is on the Support page.

5. The free tier

Ember is free to use, and the game part of it is entirely free — XP, levels, streaks, badges, challenges and friends cost nothing.

What the free tier grants each day:

• Five focus charges, which reset at midnight in your own time zone.
• One charge is 25 minutes of focus. A session longer than that spends more than one.
• A two-minute grace window. Stop a session inside the first two minutes and the charge stays yours.

Charges do not roll over, are not currency, have no cash value, and cannot be bought, sold, transferred, or refunded. We may change how many charges a day grants, or what one is worth; if we reduce them we will say so in the app first.

6. Focus Pro

Focus Pro is an auto-renewing subscription, available weekly or monthly, that grants unlimited sessions and app blocking. Current pricing is shown in the app and on your store listing before you confirm, in your own currency.

• Apple or Google bills you, not us. Payment is charged to your App Store or Google Play account on confirmation.
• It renews automatically at the end of each period unless you turn off auto-renew at least 24 hours before the period ends. Your account is charged for renewal within 24 hours of the end of the current period.
• You cancel it in your store settings, not in Ember. On iPhone: Settings → your name → Subscriptions. On Android: Play Store → profile → Payments and subscriptions. Cancelling stops the next renewal; you keep Focus Pro until the period you have paid for ends.
• Deleting your Ember account does not cancel your subscription and does not refund it. Cancel it yourself.
• Refunds are Apple's and Google's to give, under their own policies. We cannot issue them. Where the law where you live gives you a right to withdraw or a statutory refund, that right stands regardless of this paragraph.

If your subscription lapses, you keep your account, your history, and everything you have earned. You return to the free tier's daily charges, and any Pro-only cosmetic you had selected reverts to a free one until you resubscribe.

7. App blocking — what it is and is not

This section matters more than the rest, so it is in plain words.

Ember's blocking is built on the tools the operating system gives it — Apple's Screen Time (Family Controls) on iPhone and iPad, and the equivalent controls on Android. It is designed to help you keep a decision you have already made, by putting friction between you and the apps you chose to block.

It is not a security control and not a parental control. A determined person can get around it — by uninstalling Ember, revoking the permission, using another device, or using the web instead of the app. We do not promise that blocking will be complete, uninterrupted, or effective against someone trying to defeat it. Do not rely on Ember where the consequences of an app opening would be serious.

Blocking also depends on permissions you grant and can withdraw, and on operating-system behaviour we do not control. A platform update can change or remove what is possible; if that happens we will adapt as best we can, but we cannot guarantee a feature survives.

Ember does not block emergency calls or your phone's own core functions, and you must not configure it in a way you would be unwilling to be interrupted through.

8. Friends and conduct

Adding a friend lets them see your daily focus record and your streak. Only add people you are happy to share that with; remove them and the access ends.

When using Ember, do not:

• harass, impersonate, or abuse another user
• falsify your progress, or use automation, modified clients, or bugs to earn XP, streaks or badges you did not do the focusing for
• attempt to access another user's account or data, or probe our systems without our written permission
• interfere with the app's operation, or overload our services
• use Ember for anything unlawful

We may suspend or close an account that does these things. Where it is reasonable to, we will tell you why first.

9. What belongs to whom

Ember — its code, artwork, badge designs, sounds, name and look — belongs to us or our licensors, and nothing in these terms transfers any of it to you. Your focus history and your progress are yours; you are giving us only the permission we need to store it, sync it, and show it to you and to the friends you chose.

Third-party app names and logos shown inside Ember belong to their owners, and appear only to let you identify the app you want to block. Their presence is not a partnership or an endorsement in either direction.

10. Availability, and changes to the app

We work to keep Ember running, but we do not promise it will be available without interruption or free of faults. We may change, suspend, or discontinue features, and we may stop supporting older versions of the app or operating systems. If we discontinue Ember altogether, we will give reasonable notice in the app so you can export or delete your data.

11. Disclaimers

Ember is a productivity tool. It is not a medical device and not a treatment for ADHD, addiction, anxiety, or any other condition, and nothing in it is medical advice. If you are struggling with compulsive phone use, please talk to a professional.

Except where the law does not allow us to say so, Ember is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement. Nothing here excludes a right you have under mandatory consumer law where you live.

12. Our liability

To the extent the law allows, we are not liable for indirect, incidental, special or consequential losses, for lost profits, lost opportunities, or for data loss beyond our reasonable control. Our total liability to you for any claim is limited to the greater of what you paid us for Ember in the twelve months before the claim, or USD 50.

We do not limit liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not permit us to limit.

13. If you are using Ember on an Apple device

These terms are between you and us, not between you and Apple, and Apple is not responsible for Ember or its content. Providing any maintenance and support for Ember is our job, not Apple's — Apple has no obligation to provide either. If Ember fails to conform to any warranty you have, you may tell Apple and Apple will refund your purchase price if applicable; beyond that, Apple has no other warranty obligation. We, not Apple, are responsible for handling any claim about Ember — product liability, a failure to meet a legal requirement, or a consumer protection claim — and for any third-party claim that Ember infringes intellectual property. You confirm you are not in a country subject to a US Government embargo or designated as terrorist-supporting, and are not on any US Government prohibited-parties list. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

14. Ending this agreement

You can end it at any time by deleting your account and removing the app. We can end it if you materially break these terms. Sections that by their nature should survive — ownership, disclaimers, liability, and governing law — survive it.

15. Governing law

These terms are governed by the laws of the Islamic Republic of Pakistan, and the competent courts of Pakistan have exclusive jurisdiction over any dispute arising from them.

If you are a consumer, this does not take away the protection of the mandatory consumer laws of the country you live in, and it does not stop you bringing a claim in your local courts where those laws give you that right.

16. Changes to these terms

We may update these terms. We will change the date at the top, and where a change materially affects your rights we will tell you in the app before it takes effect. Continuing to use Ember after that is acceptance of the new terms; if you do not accept them, delete your account.
